Is it permissible for a husband to have intercourse with his wife at dawn in Ramadan immediately upon his arrival from travel, knowing that he cannot wait until Maghrib?

Intentionally breaking the fast in Ramadan by sexual intercourse is a grave sin that necessitates expiation. This expiation is to free a slave; if that is not possible, then to fast for two consecutive months; if that is not possible, then to feed sixty poor people.

If you return to your country before Fajr, you are obliged to fast, and sexual intercourse is forbidden. However, if you arrive after Fajr and you were not fasting during your journey, the more authoritative opinion is that you are permitted to complete the day without fasting. But it is not permissible for your wife to break her fast unless she was menstruating and became pure after Fajr.

The only situation in which it is permissible for you to have sexual intercourse with your wife during the day in Ramadan is if you arrived from your journey after Fajr and you were not fasting, and your wife had become pure from menstruation after Fajr. However, if you intended to fast during your journey or illness, and then your excuse ceased to exist, it is not permissible for you to break your fast.
