The question

What is the ruling on a husband fondling his wife and ejaculating during the daytime in Ramadan, knowing that I arrived from a journey at dawn on the third day of Ramadan, and I have not yet determined the length of my stay? Is it permissible for me to have intercourse with her? And how long is the period during which I am allowed to avail myself of the traveler's concessions?

The answer

The ruling on travel is terminated by the intention to reside for four days, or by the presence of a wife who is a resident in the city the traveler has arrived in, or by the traveler's arrival in his homeland. If none of these conditions are met, the traveler is eligible for travel concessions, such as breaking the fast due to intercourse and its preliminaries. If a traveler has intercourse with his wife while she is also traveling, there is no sin upon them, nor is there any expiation; they only need to make up the day. However, if the wife is a resident, it is not permissible for him to have intercourse with her if she is observing an obligatory fast, and she must refrain.

If a traveler who has broken his fast arrives after Fajr, there is no sin upon him if he fondles or ejaculates, and he is not required to abstain for the rest of the day. However, if he arrives before Fajr, he must fast. If he fondles and ejaculates, his fast is invalidated, and he must make up the day along with repentance. The emission of semen through fondling invalidates the fast and necessitates making up the day without expiation. If this occurs on two separate days, both fasts are invalidated, and both days must be made up, accompanied by sin and repentance.

If the traveler does not intend to reside in a way that terminates the ruling on travel, and the city is not his homeland, and his wife is not a resident there in a way that terminates the ruling on travel (i.e., her intention to reside for four days or more), then his arrival while he is traveling does not terminate the ruling on his travel, because she is also not a resident. Any journey during which shortening prayers is permissible also permits breaking the fast.
