Is it permissible for a woman to feed sixty poor people as expiation for sexual intercourse that occurred during the daytime in Ramadan of her first marriage, for fear that her current husband might find out and expose her?

A woman who has intercourse during the day in Ramadan is obligated to offer expiation (kaffarah) if she was aware, mindful, and acting by choice. According to the majority of scholars, this expiation is sequential: freeing a slave, and if she cannot find one, then fasting for two consecutive months, and if she is unable to do that, then feeding sixty poor people. Malik and, in one narration, Ahmad, held that the expiation is by choice. However, the majority preferred the sequential order because it is based on most narrations. Nevertheless, Malik's view of choice is strong and has its evidence. If fasting would cause harm to the woman, she may adopt Malik's view of feeding sixty poor people.
