Is it permissible to feed the poor instead of fasting for two months for each day the husband had intercourse with his wife during the daytime in Ramadan, while he was in an abnormal state due to drug abuse, given his repentance and remorse, and his inability to fast for this duration?

If a man has intercourse with his wife intentionally during the daytime in Ramadan, he has invalidated his fast, and two things are required of him: making up that day (qada') and expiation (kaffarah). The expiation is: freeing a slave; if he cannot find one, then fasting for two consecutive months; if he is unable to do that, then feeding sixty poor people.

If someone has intercourse while his mind is absent due to an intoxicant during the daytime in Ramadan, the expiation is not waived for him.

If the wife was fasting and willingly assented to her husband's intercourse, knowing its impermissibility, then she must make up the day and offer expiation. However, if she was coerced, or fasting was not obligatory for her, or she was ignorant, then no expiation is required of her.

He must offer expiation for each day he had intercourse. If he is unable to free a slave or fast, then he must feed sixty poor people for each day he had intercourse, in addition to making up that day.
