What is the ruling on feeding sixty poor people as expiation for one who had intercourse with his wife during the daytime in Ramadan, given the absence of freeing a slave and the difficulty of fasting for two months, and what are the consequences for the wife?

First, sincere repentance is obligatory. The expiation for intercourse during a Ramadan day, according to the majority of scholars, is fasting for two consecutive months, and one does not move to feeding [the poor] unless unable to fast. As for the wife, it is more cautious for her to offer expiation. The Maliki school of thought holds that the expiation for intercourse is on the basis of choice, and it is permissible to follow this opinion if a trustworthy scholar issues a fatwa to that effect. According to this view, it is permissible to move to feeding [the poor] even if one is able to fast.
