What is the Shariah ruling for a husband who neglects his wife in bed due to impotence that he denies, and what is the ruling for the custody of a five-month-old female infant in the event of a divorce?

A woman has the right to annul the marriage (فسخ النكاح) if her husband is impotent (عنينًا) and completely unable to have sexual intercourse. However, if the husband has engaged in intercourse even once, she does not have the right to annul the marriage. The husband must seek treatment for erectile dysfunction, and if he refuses or the treatment is not beneficial, the woman has the right to seek divorce (الطلاق) or khul' (الخلع). The custody of their daughter will be hers unless she marries a non-mahram man or there is another impediment to her custody.
