Is it permissible to take eggs from a hen whose owner is known, and which is destroying crops, given that its owner has been asked to restrain it without success?

It is not permissible to take a chicken's eggs, because they are the property of another, and it is not permissible to take them without the owner's permission, even if the chicken damages the crop. Rather, the matter should be brought to its owner. If he does not respond, then the matter should be referred to the Sharia court to compel him to restrain it or compensate the crop owner.
