The question

Is it incumbent upon one who has suffered physical harm to bear the costs of their treatment if they exceed the amount of the blood money (arsh)? And is it forbidden for them to benefit from the compensation paid to them if it exceeds the blood money (arsh) and the diyah? And is compensation for physical harm in Islamic Sharia only established up to the amount of the blood money (arsh) and the diyah?

The answer

Wounds of the body are of two types: those that are on the head or face, and those that are on the rest of the body. The 'arsh (blood money for injuries) varies according to the wounds. It may be equal to the full diyah (blood money) as in the diyah of the tongue, or half of it as in the diyah of one hand. Sometimes it may even reach the point of obligating the perpetrator to pay two diyahs. Some wounds do not have a predetermined 'arsh, so a just ruling is issued for them. As for her situation, she is entitled to receive, in addition to the 'arsh, the costs of treatment and the doctor's fees, whether she recovers completely or not.
