Must a prisoner who owns nothing, and wishes to divorce his wife due to the length of his imprisonment, pay the mut'ah (compensatory gift) and the deferred mahr (dower)?

The deferred dowry is a debt upon the husband that is not waived by his insolvency, and the wife is obliged to grant him respite. As for the compensation for a divorced woman (mut'at al-talaq (definition)), it is incumbent upon both the affluent and the struggling, each according to their capacity. One who is imprisoned and possesses nothing is not obligated to pay anything, because "Allah does not burden a soul beyond what He has given it." The prisoner is advised not to hasten to divorce if his wife is patient, for Allah may soon grant him relief, and he may regret the demolition of his home.
