The jurists have agreed upon the permissibility of making up the two Rak'ahs of Fajr, but they differed regarding their time. A group held the view that it is permissible to make them up immediately after the Fajr prayer, citing the Hadith of Qais ibn 'Amr. The Malikis and the people of opinion (Ahl al-Ra'y) held that their time is after sunrise, citing the Hadith of Abu Hurayrah: "Whoever did not pray the two Rak'ahs of Fajr, let him pray them after the sun rises." Accordingly, it is permissible for the questioner to make them up at either of the two times, and the more preferable is after sunrise.
