Which is the preponderant opinion regarding the categorization of a traveler into: a traveler who avails himself of all the concessions of travel; a resident traveler who avails himself of some of the rulings of travel; and a permanent resident—is it the opinion of Shaykh al-Islam Ibn Taymiyyah or the majority of scholars?

The majority of scholars divide people, regarding travel and residency, into three categories: the traveler, the permanent resident, and the traveler who has resided for four days. The traveler enjoys all concessions of travel. The permanent resident must observe what is incumbent upon a resident and is prohibited from utilizing travel concessions. As for the traveler residing for four days, Friday prayer is obligatory upon him, but it is not valid for him to lead it, nor is he permitted to utilize travel concessions. This division is the view of the majority of scholars.

Shaykh al-Islam Ibn Taymiyyah holds that there is no evidence for this division, and that the division of a resident into permanent and non-permanent has no evidence from the Shari'ah.
