Is the hadd punishment of stoning to death applied to a married person who committed adultery while working in another country, far from his wife for four months, or is the hadd punishment of flogging applied to him? Is it a condition for him to be described as 'muhsan' (adulterer who is married) that his wife be with him? And what is the difference between him and the 'ghair muhsan' (unmarried adulterer) if his wife is not with him?

The fornicator must repent and conceal his sin, and he is not required to inform the judge for the punishment to be carried out. Rather, concealing his sin is preferable if he repents sincerely. The conditions for ihsan (being a محسن, a married person) which necessitates stoning are six: puberty, sanity, freedom, Islam, a valid marriage contract, and lawful intercourse. It is not a condition for the continuation of ihsan that the wife remains under his marital bond or that he is present with her.
