One must prohibit the one who swears by other than Allah and clarify that his action is forbidden and constitutes minor shirk. He should be commanded to say: "Lā ilāha illā Allāh (There is no god but Allah)" as an expiation for his action. As for laughing at a person's appearance or manner, it is not considered disbelief (kufr).
