Does Fatwa No. (95364) regarding the prohibition of torturing animals in hunting apply to fishing with live bait, especially since some fish can only be caught this way, and fishermen rely on it as a primary source of livelihood? And does the same fatwa apply to traps (snares and perches) used for hunting falcons by placing a net over pigeons or quails?

It is permissible to use live bait for fishing and other purposes if it serves a valid interest or benefit, such as fishing for livelihood, and not merely for amusement or torturing the animal. This is because Allah has subjected what is in the heavens and what is on earth to humankind for their benefit, as stated in His Almighty قول: "And He has subjected to you whatever is in the heavens and whatever is on the earth - all from Him" and His قول: "It is He who created for you all of that which is on the earth."
