Does a divorce take effect if the wife falsely swears on the Qur'an after her husband says: "You will be divorced if you falsely swear on the Qur'an"?

Swearing falsely upon the Qur'an is a heinous sin that necessitates repentance and seeking forgiveness. Scholars have differed regarding the obligation of expiation (kaffarah) for one who intentionally swears a false oath. It is more prudent to perform it.

As for the phrase "you will remain divorced" (تبقين طالقا), it could signify either a promise of divorce or its immediate effectuation. Therefore, you must ask your husband what he intended:

1. If he intended a promise of divorce: Then nothing is binding on him unless he divorces anew.

2. If he intended to immediately effectuate the divorce, meaning it occurred upon his false oath: Then the divorce took place according to the majority of scholars, and he may take you back (raj'ah) if it was not the third divorce.

3. Ibn Taymiyyah held that an expiation for an oath (kaffarat yamin) is binding if the husband intended to threaten or prevent, not to divorce.
