Is the error of the Commander of the Faithful, Umar ibn al-Khattab, may Allah be pleased with him, in this situation, a justification for dropping one of Allah's prescribed punishments, knowing that the Prophet, peace and blessings be upon him, said: "By Allah, if Fatimah, daughter of Muhammad, were to steal, I would cut off her hand"?

We have not found a reliable story about Umar (may Allah be pleased with him) with the aforementioned description. Al-Qurtubi mentioned that Abdur-Rahman ibn Awf guarded one night with Umar, and they saw a lamp and a house with loud voices and coarse language. Umar thought they were drinking wine. Abdur-Rahman forbade him from spying, citing Allah's saying: "And do not spy" [Quran 49:12]. So Umar turned away. If it had been confirmed to Umar that they were drinking wine, he would have carried out the prescribed punishment on them.
