Does the divorce of a person suffering from severe obsessive-compulsive disorder (OCD) occur, when he utters allusions to divorce and thinks about it under the influence of the obsession, and sends his wife to her family with the intention of divorce, while he has no real will to divorce or to retain, knowing that he is aware of what is happening but feels compelled to do it?

The divorce of one afflicted with severe obsessive-compulsive disorder (waswas), especially one who has reached your condition, is not valid. Therefore, do not pay attention to these delusions.

Imam Al-Shafi'i said: "And whoever is overcome in his intellect by a natural predisposition or an accidental illness, for which he did not bring upon himself by an act of disobedience, is not obligated by divorce, nor prayer, nor penalties. This is like the imbecile, the insane, the one afflicted with waswas, and the one suffering from brain fever."
