Are females entitled to dispose of their money which their father gifted to them, on the grounds that the father is still alive?
If a father gifts something to his male and female children during his lifetime, while not afflicted with a death-illness (marad al-mawt), and the children take possession of the gift, then they have the right to dispose of it through usufruct, sale, or other means. No one has the right to prevent another from selling. If the gift is completed with its legal conditions, and the donee has taken possession of their share and is an adult of sound judgment, then they have the right to dispose of it as they wish. The statement that females are not allowed to sell their share of the gift as long as the father is alive is a statement made without knowledge, for no one's disposal of their wealth can be restricted except with a legitimate legal justification and by order of the ruler.
