Does a triple divorce occur if a husband says to his wife, "You are divorced," twice consecutively while angry and aware of what he is saying, and his wife was menstruating, and he had previously divorced her once?

So long as the husband uttered a clear divorce statement, understanding what he was saying and not being overcome by emotion, his divorce is effective. Since he repeated the divorce utterance twice, with كلام (other speech) in between, these are two divorces. Divorcing a menstruating woman is an unlawful, innovative divorce (طلاق بدعي), but it is considered valid by most scholars, and this is the most preponderant opinion. Based on a previous divorce, the woman has now been divorced three times, and she is irrevocably separated from him (بينونة كبرى). Some scholars are of the opinion that only one divorce occurs if the husband repeats the divorce before a رجعة (reconciliation) or a new marriage contract. Since there is a difference of opinion on this matter, it is best to present it to an Islamic court or trustworthy scholars.
