Is it permissible for an employee, whose company pays the premiums for commercial health and life insurance, to claim from the insurance an amount exceeding his due and then dispose of the surplus, or to dispose of the surplus allocated to a colleague who did not benefit from their insurance? And does an employee's signature on a compulsory insurance enrollment request make it voluntary?

Commercial insurance is forbidden due to its inclusion of gharar (excessive uncertainty) and gambling. It is not permissible to willingly participate in it. However, if a company compels its employees to participate, it is permissible for them to do so, and the sin lies with those who compelled them.

The employee who is compelled to participate in commercial insurance may only take the amount paid on their behalf. They must dispose of any excess by giving it to the poor and needy.

It is not permissible to sign a forbidden insurance contract except for the one who is compelled and cannot find other work. Otherwise, one must leave the job that requires such participation.
