Is it permissible for the heirs to compel one of the daughters to take her share of the inheritance in money instead of real estate? And is resorting to the court to obtain one's right considered a tribulation (fitna) or an act of disobedience (maʿṣiyah), especially with the mother's disapproval? And can the eldest brother and his siblings, who took their shares 10 years ago, return to the inheritance?

It is not permissible to prevent any heir from taking their legal share of inheritance. For a minor, their guardian manages their wealth. As for an adult of sound judgment, they have the right to demand their full share. If they are prevented, they may refer the matter to the Sharia court. We advise mediating between the sister and her brother through people of Islamic knowledge. If he does not retract his injustice, she should refer the matter to the court, and there is no sin upon her for doing so, because "Allah deters with the ruler what He does not deter with the Quran."
