What is the ruling on money taken from a health insurance company as compensation for stopping work to care for a sick non-Muslim wife while performing the Hajj pilgrimage?
Whoever intends to perform Hajj must ensure their money is lawful, for Allah is good and accepts only what is good. The majority of scholars hold that Hajj is valid and sufficient if performed with unlawful money, though the person incurs sin and their reward is diminished. However, Imam Ahmad was of the opinion that it is not sufficient.
As for the money the questioner's friend receives from the insurance company for the care of his wife, if this payment is a form of social welfare due to his job loss, then there is no harm in it. However, if it is because his wife is insured with the company, he should only take an amount equivalent to what she paid, because commercial insurance is forbidden by Islamic law due to the elements of gharar (excessive uncertainty) and gambling it contains.
