The question

Is the husband entitled to take his wife to his home without consulting her father, knowing that he has not yet consummated the marriage, and her father wishes to separate them and is bargaining with him over the amount paid to furnish the apartment, and is he obliged to leave half of the amount for her father in the event of divorce at his request?

The answer

If you have paid the prompt dower (mu'ajjal al-sadaq) to your wife, then you have the right to consummate the marriage with her, and neither she nor her guardian has the right to prevent you. If your wife seeks a divorce without harm, you are not obligated to grant her request, and you may refuse until she gives you compensation or waives her rights or some of them. However, if you divorce her without stipulating that she waive any of her rights, she is entitled to half of the dower, unless she waives it, or you waive the other half for her.
