Regarding swearing by divorce, the majority of scholars hold that divorce occurs absolutely upon breaking such an oath, and this is the ruling that is given. However, the husband's breaking of the oath depends on his intention and what he meant by what he uttered; if he intended a threat and carried it out, he has not broken the oath. Otherwise, he has broken it and his divorce occurs. The lawful oath is by Allah Almighty, and swearing by divorce is forbidden by Islamic law.
