Swearing by divorce leads to the occurrence of divorce according to the majority of scholars if the sworn-upon condition is met, and this is the fatwa we adhere to. This differs from the view of Ibn Taymiyyah, who holds that it is an oath requiring an expiation for an oath (kaffarat yamin) and does not result in divorce, provided that the intent was not to make the divorce contingent but rather to threaten.

Accordingly, if the father made the divorce of the mother contingent upon her raising her voice, and he heard her raise her voice, then the divorce occurs. However, if he was absent, it does not occur.

And she must avoid raising her voice unnecessarily, as the Sharia prohibits it, based on the Almighty's saying: "And be moderate in your pace and lower your voice; indeed, the most disagreeable of sounds is the voice of donkeys" (Luqman: 19). This simile implies prohibition and condemnation of a loud voice, and if it is disliked from men, then it is even more so from women.
