Does one who did not perform Tawaf Al-Ifadah on Eid al-Adha need to re-enter a state of ihram until he performs it?
The hadith of Umm Salama (may Allah be pleased with her), which states that whoever does not perform the circumambulation of Ifadah before sunset on the day of Eid returns to a state of ihram, is a weak hadith that cannot be used as a proof and is not authentically attributed to the Prophet (peace be upon him), for the following reasons:
1. Weakness of the Sanad (Chain of Transmission): Its chain revolves around Muhammad ibn Ishaq, whose unique narrations contain some anomalies; around Abu Ubaydah ibn Abdullah ibn Zam'ah, who is acceptable but not known for his strong memory; and around Abdullah ibn Lahi'ah, who is truthful but became confused after his books were burned.
2. Oddity of the Matn (Text): Its text is odd because the authentic and corroborating hadiths indicate that the first disengagement from ihram occurs before circumambulating the House (Kaaba), without the condition that it must happen before sunset.
3. Lack of Practice: The imams and scholars, except for a very few, did not act upon it. Al-Tabari, Al-Nawawi, and Al-Bayhaqi reported that no jurist is known to have held this opinion, which indicates that it is not acted upon.
4. Contradiction with Juristic Principles: Its implication contradicts the juristic principles which state that once a person disengages from an act of worship, they do not return to it except with a new intention.
