Is a wife divorced if her husband tells her: "You are divorced if you leave the threshold of the house," and she does not leave, but goes to her maternal uncle's house next door by way of the roof?

The husband's intention is significant. If the wife does not leave in the manner the husband intended, nothing occurs.

However, if she does leave in the manner he intended, divorce takes place according to the majority of jurists, whether the husband intended divorce or merely a threat.

Ibn Taymiyyah holds the view that divorce does not occur if the husband did not intend divorce.

One must be cautious about rushing into pronouncements of divorce.
