Is it permissible to rent a shop mortgaged to the bank, with the possibility of the shop owner settling his debts from the monthly rent?

Scholars differed regarding the ruling on the mortgagor leasing the mortgaged property without the mortgagee's permission. Some, like Ibn Qudamah, prohibited it absolutely. Others, like Malik and Al-Shafi'i, permitted it if the lease period ends before the debt becomes due, and this is the preferred view if the lessee is trustworthy.
