Is it permissible to perform Tayammum with earth taken from public land without seeking permission?
There is no objection to performing tayammum with someone else's dust without their permission, because custom and common practice allow for leniency in this matter. Ibn Muflih stated in "Al-Furu'": "If one performs tayammum with another's dust, it is permissible according to the apparent meaning of their statements, due to customary and traditional permission, similar to praying on someone's land." And even if the owner of the dust did not give permission, performing tayammum with it is sufficient according to the majority of scholars, though repentance from the usurpation is obligatory through remorse, a firm resolve not to repeat the act, and seeking forgiveness from the owner of the right.
