Is a wife entitled to seek a divorce from her husband who mistreats her and takes her money without her permission, while demanding the return of what he took and usurped from her money, gold, and furniture, and without him returning any part of what he gave her as a dowry?
What a husband does by beating his wife, insulting her, insulting her family, and taking her money is forbidden and considered one of the major sins. It is a sufficient reason for seeking divorce, and it is preferable to separate from a wicked husband. The wife is not obligated to spend; rather, the husband is obligated to do so. Whatever the wife has spent from her money on her husband, she has the right to reclaim it from him, whether he divorces her or keeps her. The husband is obligated to return her money that he took from her by force, and what she gave him under threat, as well as the mahr. The wife is permitted to refer her case to the authorities to obtain her rights from him. If the marriage is temporary for a specified period, it is a void nikah mut'ah (temporary marriage) and must be annulled immediately.
