What is the ruling on adopting the fatwa that divorce does not occur with the phrase "by divorce" (ali al-talaq) if it has caused recurrent whisperings (waswas)? And must the marriage contract be renewed?

The divorce, in the form mentioned, "I divorce my wife thrice," does not take effect as long as the speaker has not completed his statement. This is the fatwa (definition) given by Sheikh Alish Al-Maliki, and it is also how Imam Malik responded to someone who said, "I divorce my wife thrice," and then fell silent.
