Divorce does not occur by mere intention; rather, it occurs by verbal utterance, or an understandable gesture, or clear writing, provided it is established. There is no dispute regarding the occurrence of divorce issued by someone serious. As for someone joking, the majority of scholars believe that explicit divorce issued by him is valid, based on the hadith: "There are three matters whose seriousness is serious and whose jesting is serious: marriage, divorce, and revocation [of divorce]." As for writing down a divorce, it does not take effect unless there is intention. If divorce is not intended by it, then it does not occur. Spouses should fear Allah and not treat His rulings as a mockery.
