How is the salary of a deceased man distributed, who was supporting two minor children and their mother, as well as the deceased's mother?
If the salary is a right owed to the deceased by the state or the employer, it is to be divided among all his heirs, like the rest of his possessions. If the heirs are limited to the mother, wife, and two sons, then the mother receives one-sixth, the wife one-eighth, and the remainder is divided equally between the two sons.
However, if the salary is a grant from the state to the employee's dependents after his death, then it belongs to whomever the granting authority designates. If it does not designate anyone and makes it for the heirs, then it is divided according to their Sharia shares.
It is necessary to refer inheritance matters to the Sharia courts for investigation and to ensure that there is no other heir, or wills, or debts, or rights that take precedence over the rights of the heirs.
