What is the ruling on a partnership where a man receives one-third of the profit in exchange for his work as a driver of a truck owned by the other party, and what are the implications of this partnership in the event of loss or damage to the truck?

It is permissible for someone who owns an animal or a car to give it to someone to work with it for a shared portion of the profit. This is the more preponderant view among scholars, by analogy with musaqat (sharecropping of trees) and muzara'ah (sharecropping of land). Just as it is permissible to give land to someone to cultivate for a portion of its produce, so too is it permissible to give something that yields benefit for a portion of its profit. The hand of the worker is that of a trustee (yad amanah), so he does not guarantee losses except in cases of negligence.
