Is it permissible to request a small government deal from a brother in exchange for a percentage of the profits to pay off accumulated debts, and is this transaction considered bribery? And do I bear the debts alone due to the evasion of partners?
We pray to Allah to relieve the questioner's distress, settle his debt, and guide him. Such disputes between partners require direct consultation with scholars or a Sharia judge. Generally, debts incurred by a company are binding on all partners. Regarding the request to secure a public tender, if your brother is responsible for awarding contracts through bidding, and you asked him to award you a tender directly, this is impermissible. However, if your brother is authorized to award contracts directly, there is no harm in asking him, but it is impermissible for him to take payment for his work; otherwise, it would be a prohibited bribe. If you are qualified for the contract and find no way to obtain it except by paying a bribe to your brother, you may pay it, but it remains forbidden for him to take it.
