A husband who speaks obscenely with women, neglects his wife, hurts her feelings, and falls short in providing the obligatory maintenance and conjugal relations, is unjust and derelict in his duty to his Lord and to his wife. In this situation, the wife has the right to refer her matter to the Sharia judge to deter him or to rule for divorce due to harm. As for the husband's desire to marry another woman, there is no objection to it if he is capable of being just between his wives, and the wife does not have the right to object unless she stipulated in the marriage contract that he would not marry another, in which case she would have the right to annul the marriage if he does marry. It is imperative that divorce not be resorted to except after all means of reconciliation have been exhausted.
