What is the share of the deceased woman's remaining tribe members from her inheritance, when she has no heir except her mother?
If the deceased (Madinah Muhammad Othman) left no heirs other than her mother, then all her inheritance goes to the mother after fulfilling the obligatory rights such as debt, mortgage, and bequest.
However, if there is an 'asabah (agnate) among the tribespeople, he takes the remainder after the mother's share (one-third). The 'asabah are: the father and his ascendants, the full or paternal brother and his descendants, the full or paternal uncle and his ascendants, and the son of the full or paternal uncle and his descendants.
If there is no 'asabah, then the remainder after the mother's share is returned to her, and none of the Dhu al-Arham (relatives by blood or marriage who are not legal heirs) are given anything; because returning the remainder to the legal heir (other than the spouses) takes precedence over inheriting by Dhu al-Arham.
It must be noted that matters of inheritance are serious and complex, and it is not sufficient to rely solely on a . Rather, they must be referred to the courts for investigation and consideration, as there may be wills, debts, or other rights that take precedence over the heirs' rights.
