Is the husband sinful for divorcing his wife, or for not having intercourse with her for several months, knowing that he refrains from doing so due to his lack of desire for her, and his desire to divorce her to avoid having children with her?

The preservation and continuation of married life is a legitimate objective in Islamic law, and divorce entails significant harms. One cannot find a spouse free of flaws. Allah Almighty says: "But perhaps you hate a thing and Allah makes therein much good." We advise the husband to hold onto his first wife and marry another—especially with her consent—and not deprive himself of having children with her. Divorce is originally permissible, but it may be disliked, forbidden, or obligatory depending on the circumstances. There is no sin in refraining from intercourse for a period not exceeding four months, but it is better to seek reward by considering the wife's needs.
