What is the ruling concerning the action of a husband who took his wife from her father's house without his knowledge, and is that considered kidnapping, and is she still legally his wife?

If the daughter's husband is a drug addict and dealer, and persists in this, it is better for his wife to separate from him through divorce or khul' (divestiture). Al-Mardawi said: "If the husband neglects the right of Allah, the woman in that is like the husband, so she frees herself from him by khul' or similar means." However, as long as the court has not ruled for khul' or divorce, the marital bond remains, and the husband has the right to have his wife with him. Her father does not have the right to remove her from his house before the court separates them. It is advisable to strive to reform the husband, but if he does not repent, it is better for her to separate from him.
