Is it permissible to pay a sum of money to an individual in exchange for him granting a construction project based on sale, knowing that he holds influence that facilitates his acquisition of projects which he then sells to contractors?

It is permissible for someone who owns the right to build or import to relinquish it to another in exchange for compensation. This is known as "waiving" or "relinquishing" (isqat or faragh), and it is not a sale of the right itself. Maliki and Hanafi jurists have permitted compensation for certain rights, such as the right of pre-emption (shuf'ah), a woman gifting her day (of conjugal rights) to her co-wife, waiving the right to custody, and relinquishing official positions. However, it must be noted that some rights cannot be waived or compensated for. Furthermore, there is a difference between someone who owns the usufruct (manfa'ah), for whom compensation is permissible, and someone who only has the right to use (intifa'), for whom it is not permissible. It is a condition that the relinquisher be the owner of the right. If he is a middleman who takes a bribe in exchange for facilitating a project, then it is not permissible to deal with him, and those who contribute to spreading corruption and undermining rights must be boycotted.
