If the three divorces (ṭalāq) occur separately during periods of purity in which the husband did not engage in intercourse, then the woman becomes irrevocably divorced (bā’inah baynūnah kubrā) and is not lawful for him until she marries another husband. This is the view of the majority of scholars. However, if the three divorces occur in a single session or with a single utterance, which is an innovated divorce (ṭalāq bid‘ī), there is a difference of opinion among scholars regarding it. The majority hold that it takes effect. The court may, however, rule that the triple divorce in a single session does not take effect, and it has the discretion to rule according to what it deems most sound.
