What is the ruling on the oath, "By God, she will not enter America except with you," under the aforementioned circumstances?

Scholars have differed concerning the ruling on swearing by something unlawful (al-haram), and some of them distinguished between intending thereby divorce, or dhihar, or an oath, which is the relied-upon opinion for fatwa.
