Is foreplay that led to the emission of semen considered a valid seclusion (khalwa shar'iyya) that would return the wife to her husband without renewing the marriage contract after his apostasy and repentance, taking into consideration that their families did not enter upon them except after seeking permission, and must he inform his wife of anything?

The true nature of conjugal privacy (khalwa) between spouses cannot be definitively determined, as it varies from one situation to another and from one country to another. A valid khalwa is one where there is no impediment to intercourse (whether real, legal, or natural). If the private moments between them do not typically allow for intercourse, then the wife has become irrevocably separated from her husband due to his apostasy, and he has no claim over her except with a new marriage contract. However, if the khalwa is such that intercourse is possible, the majority view is that separation occurs at the moment of apostasy, and a new contract is required. Imam Shafi'i and one narration from the Hanbalis hold that separation is contingent upon the expiration of the iddah (waiting period). If the husband repents and returns to Islam during the iddah, he remains married under the previous nikah, and this is the preponderant opinion. If the husband repents before the expiration of his wife's iddah, the marital bond continues, and he is not required to inform his wife. If he does not repent until after the iddah has expired, then the wife must be informed because the marital bond has been severed, and they may renew the contract if they wish.
