The implementation of the punishment for sodomy is the responsibility of the ruler. The punishment is to be carried out on both the perpetrator and the one upon whom the act is committed, based on the Prophet Muhammad's (peace be upon him) saying: "Whoever you find doing the action of the people of Lot, kill the doer and the one to whom it is done." Jurists have agreed on the implementation of this punishment on disbelievers. Ignorance of the punishment does not excuse one, even if one does not know what consequences follow the act. However, ignorance of the Sharia ruling does excuse one. The justification for implementing punishments on disbelievers is evidenced by what was narrated about the Prophet Muhammad (peace be upon him) stoning the two adulterous Jews after they confessed to the existence of the ruling of stoning in the Torah.
