The answer

The arbiter in disputes is the Sharia courts or their equivalent. Sharia came to preserve people's rights, permit compensation for harm, and punish offenders. The amount of compensation due cannot be estimated except by a Sharia judge who is aware of the case's details. Compensation for physical harm is permissible, and the cost of medicine and treatment shall be borne by the offender. However, emotional damage cannot be compensated for financially. It is permissible to reconcile over a financial compensation for what necessitates Qisas (retribution), and there is no harm in accepting and benefiting from it, even if it is more than the legally prescribed blood money (Diyah). It is also permissible to reconcile over Qisas by offering more or less, according to the agreement.
