Is it permissible for a man who has proposed to a young girl and solemnized his marriage contract with her to verbally agree with her family to postpone the consummation of the marriage and seeing and speaking with the girl for one year? And is this condition valid if it is written down in the contract?

The fundamental principle in a marriage contract is the permissibility of everything between the spouses and the wife's relocation to her husband's home. However, the woman has the right to postpone moving to her husband or to refuse to surrender herself until she receives her sadaq (dowry), or for a legitimate reason such as preparing what she needs. If there is a condition to postpone the consummation for a specified period (e.g., one year), some scholars have validated it because it does not contradict Islamic law and because of the benefits it entails, such as preventing corruption and damage to reputation if the wife were to consummate the marriage in her father's house. The condition of not being in seclusion with the husband or going out with him is also valid for the same reasons. As for the condition of not seeing her or speaking to her for a year, it is void because it contradicts the essence of the contract. An oral condition is like a written one, provided it exists before or at the time of the contract; however, if it is made after the contract, it is not binding.
