Is it necessary to renew the marriage contract immediately upon a man's repentance from apostasy that occurred before consummation, or is it obligatory to wait for a period of istibra’ (waiting period to ensure non-pregnancy), or menstruation, or ‘iddah (waiting period after divorce/death of husband)?

If a husband apostatizes before consummation, the marriage is annulled according to the majority of scholars. If he then embraces Islam and wishes to marry his former wife, it must be with a new contract. If the husband is unaware of this and consummates the marriage with his wife without renewing the contract, it is considered intercourse by شبهة ( شبهة (sexual intercourse in doubt of legitimacy) ) which establishes paternity. He is then permitted to عقد (marry) her thereafter without استبراء (waiting for the clearing of the womb) or عدة (waiting period), because the woman will observe the عدة from him, and the عدة is for the preservation of his lineage. Nevertheless, observing the عدة is more cautious and avoids disagreement.
