What is the ruling on a marriage to a man whose mother dominates him after promises she did not fulfill, causing the spouses to suffer from poor financial and living conditions, and the wife cannot prevent the husband's mother from visiting her out of fear of Allah?
The husband must provide an independent dwelling for his wife and spend on her according to what is customary. If he does not, he is deficient. However, the marriage is valid if it fulfills its pillars and conditions. It is advisable to be patient with the husband if he is a man of faith and good character, and to supplicate frequently. It is not advisable to seek divorce unless the situation becomes difficult due to the lack of maintenance or an independent dwelling. In this case, the woman has the right to seek divorce, based on the Almighty's saying: ﴿Retention with righteousness or a release with kindness﴾ and ﴿And do not retain them to harm them, so as to transgress﴾. It was also reported from the Messenger of Allah, peace and blessings be upon him: "If a man becomes unable to provide for his wife's maintenance, they should be separated." And Umar ibn al-Khattab wrote to the commanders of the armies to either provide for them or divorce them.
