The question

Is it permissible for a husband to remarry his wife after a divorce in which consummation did not occur? Is she forbidden from marrying another? Is her waiting for him after the annulment of the contract considered unlawful? And does God hold a person accountable for their intense love for someone?

The answer

We advise that marriage should be made as easy as possible and without exaggeration. It is permissible to persuade the parents to be patient with the young man and facilitate matters for him to complete the marriage. If it is not possible to persuade the parents, and the girl fears harm to herself, then she is not obligated to obey them.

If a divorce occurs before consummation, it results in a minor irrevocable divorce (baynunah sughra), and the husband can take his wife back with a new contract. As for the divorce that makes the wife unlawful for her husband until she marries another husband, it is the triple divorce, which leads to a major irrevocable divorce (baynunah kubra).

There is no harm in waiting for the husband after a divorce, but marriage should not be delayed if another satisfactory suitor proposes. As for supplication, a woman can supplicate with the prayer of one in distress, such as: "O Allah, it is Your mercy I hope for, so do not abandon me to my own soul even for the blink of an eye, and correct all my affairs for me. There is no god but You," or "O Allah, there is no ease except that which You make easy, and You make the difficult easy if You wish," or "O Ever-Living, O Sustainer, by Your mercy I seek aid. Correct all my affairs for me, and do not abandon me to my own soul even for the blink of an eye."

Regarding love, if it is between spouses, there is no harm in it. However, love before marriage requires elaboration.
