Is a wife entitled to seek divorce and annulment of the marriage contract, and is she obligated to return the dower, if she is subjected to insult, ridicule, verbal and physical abuse, interference from her husband's family in her marital life, in addition to inspection of her personal belongings and phone, knowing that she had previously returned to her family's home then returned to the marital home and the problems escalated?
If the husband has bad manners and treats his wife poorly, the wife has the right to seek divorce. If reconciliation between the spouses is not possible, then divorce is better, and Allah may enrich each of them from His bounty. The woman is not obligated to return the dowry if she is divorced, unless it is a khul' (divorce at the wife's instance) in exchange for compensation. It is not permissible for the husband to take compensation if he was the cause of the harm. The husband must provide a separate dwelling for his wife, and she must fulfill his rights even if he falls short, and she is not permitted to leave his house except for a legitimate excuse.
